Terms of Service

These Terms of Service (the "Terms") govern your use of Stack Atlas (the "Service"), accessed at stackatlas.app and operated by Daniel Spatari ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance
By accessing, browsing, or using the Service in any way (including submitting picker inputs, signing in, or creating an account), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. Continued use after any update to these Terms means you accept the updated Terms.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.
2. The Service
Stack Atlas is an opinionated tool-stack recommendation engine for the creator, coach, and agency economy. You answer a 7-dimension picker about your business shape; we return a curated stack recommendation, anti-recommendations, peer statistics, and reasoning. The Service is currently free to use. We may introduce paid features in the future, governed by these Terms or a supplementary agreement.
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms in your jurisdiction. If you are between 13 and 18, you may use the Service only with parental or guardian consent and supervision; under 13, you may not use the Service at all.
4. Account & Authentication
The Service uses passwordless authentication via magic link or Google OAuth. You are responsible for:
- Keeping your email account and Google account secure.
- Not sharing magic links or session cookies with anyone else.
- Notifying us promptly at hello@stackatlas.app if you suspect unauthorized access.
We are not liable for losses arising from compromised email or OAuth accounts that are not under our control.
5. Acceptable Use
You agree not to:
- Use automated tools, scripts, or bots to interact with the Service (scraping, mass submissions, credential stuffing, etc.).
- Submit picker inputs that are abusive, deceptive, defamatory, illegal, or designed to game the recommender engine.
- Attempt to access, probe, or interfere with non-public areas of the Service, our infrastructure, or other users' accounts.
- Reverse-engineer, decompile, or extract the recommendation logic, opinion mappings, or anti-recommendations for the purpose of replicating or competing with the Service.
- Resell, sublicense, or commercially redistribute the Service's output (including stack recommendations and reasoning) without prior written consent.
- Use the Service to harass, defame, or violate the rights of any person or entity.
We may suspend or terminate access at our discretion if you violate any of the above.
6. User Submissions
When you complete the picker, you submit:
- Seven business-shape dimensions (business type, phase, delivery shape, ticket point, team size, niche text, growth channel).
- Optionally, an email address (for magic link sign-in) or Google account info (for OAuth).
You retain ownership of the inputs you submit. By submitting them, you grant us a worldwide, royalty-free, non-exclusive license to:
- Process the inputs to generate your stack recommendation.
- Aggregate the inputs in anonymized, statistical form to improve the Service and produce peer statistics shown to other users (e.g., "what 250 similar coaches chose"). Aggregated peer data does not identify you personally.
You represent that your submissions do not include another person's confidential or personal information without their consent, and do not infringe any third-party rights.
7. Recommendations Are Opinions
Stack Atlas recommendations are opinionated guidance based on operator experience, not professional, legal, financial, tax, or business advice. Tool fit depends heavily on context we cannot fully observe, and tools change pricing, features, and policies constantly. You are responsible for evaluating any recommended tool's suitability, terms, security posture, and pricing before adopting it.
We make no warranty that:
- Any recommended tool will meet your needs.
- Any recommended tool will remain available, priced as described, or compatible with other tools in your stack.
- The Service's recommendations will produce any specific business outcome.
You use any recommendation at your own risk.
8. Third-Party Services
The Service references and links to third-party tools and platforms (the "Third-Party Services"). We are not responsible for, and have no control over, the content, terms, pricing, security, or availability of any Third-Party Service. Your use of any Third-Party Service is governed by that service's own terms, not ours.
9. Intellectual Property
We own the Service and all associated intellectual property, including but not limited to:
- The recommender engine logic, opinion mappings, anti-recommendations, scoring algorithms, and reasoning content.
- The Stack Atlas name, logo, and brand assets.
- The website design, copy, and layout.
You may use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works of the Service or its content except as expressly permitted by these Terms or applicable law.
Your submissions remain yours per Section 6.
10. Modifications to the Service
We may add, change, suspend, or discontinue any part of the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation, except as required by applicable law.
11. Modifications to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Material changes will be communicated via the Service or by email if you have an account. Continued use after the effective date of an updated version means you accept the update.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF MALICIOUS CODE.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusion may not apply to you to the extent prohibited by law.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost opportunities, or business interruption, arising from or related to your use of the Service.
- Our total aggregate liability for any claim arising from or related to the Service will not exceed the greater of (a) the total fees you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred euros (EUR 100).
This limitation applies regardless of the legal theory (contract, tort, statute, or otherwise) and even if we have been advised of the possibility of such damages.
14. Indemnification
You agree to indemnify, defend, and hold harmless Daniel Spatari and Stack Atlas from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising from:
- Your use of the Service in violation of these Terms.
- Your violation of any law or third-party right.
- Content you submit through the Service.
- Your use of any Third-Party Service.
15. Termination
You may stop using the Service at any time. You may request account deletion by emailing hello@stackatlas.app.
We may suspend or terminate your access immediately, with or without notice, if you breach these Terms, misuse the Service, or if required by law. Termination does not relieve you of obligations accrued before termination.
Sections that by their nature should survive termination (including 6, 9, 12, 13, 14, 17, and 18) will survive.
16. Force Majeure
We are not liable for any delay or failure to perform caused by events outside our reasonable control, including but not limited to internet or hosting outages, third-party platform failures or policy changes, government actions, natural disasters, pandemics, or war. If a force majeure event continues for more than 30 days, either party may terminate by written notice.
17. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Moldova, without regard to its conflict-of-laws rules. Any dispute arising from or related to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Chișinău, Moldova, except where mandatory consumer-protection laws of your country of residence provide otherwise.
We are relocating our operating entity to the United Arab Emirates in 2026. Once that entity is active, we will update this section accordingly. Until then, the above governs.
18. Dispute Resolution
Before filing any formal claim, you agree to contact us at hello@stackatlas.app with a written description of the dispute and attempt to resolve it informally for at least 30 days. If we cannot resolve it informally, either party may pursue the remedies available under Section 17.
19. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
20. No Waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
21. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreement, understanding, or communication on the subject.
